3. Filing a DMCA Takedown Notice

If you are a copyright owner, or an agent authorized to act on behalf of a copyright owner, and you believe that content available through our Services infringes one or more of your copyrights, you may submit a DMCA takedown notice by providing our designated agent with the following information in writing:

  1. Signature: A physical or electronic signature of the copyright owner or authorized representative.
  2. Identification of Work: Identification of the copyrighted work claimed to have been infringed.
  3. Identification of Material: Identification of the material claimed to be infringing and URLs to locate it.
  4. Contact Details: Your address, telephone number, and email address.
  5. Good Faith Statement: A statement that you have a good faith belief that use of the material is not authorized.
  6. Accuracy Statement: A statement under penalty of perjury that the information in the notice is accurate.

Legal Warning: Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorneys' fees. Seek legal advice if you are unsure.

Upon receipt of a valid DMCA notice, we will act expeditiously to remove or disable access to the allegedly infringing material and will take reasonable steps to notify the user who posted it.

4. Counter-Notification Process

If you believe that material you posted was removed or disabled as a result of mistake or misidentification, you may file a counter-notification with our designated agent. A valid counter-notification must be in writing and include:

  1. Signature: Your physical or electronic signature.
  2. Identification of Removed Material: Identification of the removed material and its location before removal.
  3. Statement Under Penalty of Perjury: A statement of your good faith belief that it was removed in error.
  4. Consent to Jurisdiction: Consent to the federal district court of your address's judicial district.
  5. Contact Details: Your name, address, and telephone number.

Upon receipt of a valid counter-notification, we will promptly forward it to the complaining party. If no court action is filed within 10 to 14 business days, we may restore the removed material at our discretion.

5. Repeat Infringers

In accordance with the DMCA, it is the policy of Your Insurance Pro to terminate access or accounts of users who are deemed to be repeat infringers, in appropriate circumstances and at our sole discretion. A repeat infringer is defined as a user who has had infringing material removed on more than two occasions.

6. Modifications to This Policy

We reserve the right to modify this DMCA Notice & Takedown Policy at any time. Any changes will be effective immediately upon posting the updated policy on our website.
